1. About sheerME

sheerME (“we”, “us”, “our”) operates an online marketplace and booking platform that connects consumers with beauty and wellness service providers (“Salon Partners”) in Portugal and, in time, across the EU. We also operate a cashback rewards programme for eligible platform users.

2. Eligibility

To use sheerME, you must:

• Be at least 16 years of age.
• Be a natural person acting for personal (non-commercial) purposes, or a business representative with authority to bind the business (for Salon Partner accounts).
• Provide accurate and complete registration information.
• Not have been previously suspended or removed from the sheerME platform.

3. Your Account

When you create an account, you agree to:

• Provide truthful, accurate, and up-to-date information.
• Keep your password confidential and not share it with others.
• Notify us immediately at [email protected] if you suspect unauthorised use of your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.

4. Using the Platform

sheerME grants you a limited, personal, non-transferable, non-exclusive, revocable licence to access and use the platform for its intended purposes. You agree not to:

• Scrape, crawl, or systematically extract data from the platform.
• Reverse engineer, decompile, or attempt to access the platform’s source code.
• Use the platform in any way that could damage, overload, or impair our systems.
• Circumvent any access controls or security measures.

5. Cashback Programme

5.1 How Cashback Works

When you complete a verified booking through sheerME with a participating Salon Partner, you earn cashback credited to your sheerME wallet. Cashback rates vary by treatment category and Salon Partner and are displayed at the time of booking.

5.2 Pending and Available Cashback

Cashback is marked as “pending” upon booking and becomes “available” once the appointment is confirmed as completed. Completion is typically verified within a few hours of the appointment end time.

5.3 Forfeiture of Cashback

Cashback is forfeited in the following circumstances:

• You cancel an appointment within 24 hours of the scheduled time.
• You fail to attend the appointment (no-show).
• The booking is found to have been made fraudulently or in bad faith.
• Your account is terminated for breach of these Terms.

5.4 Cashback Modifications

sheerME reserves the right to modify cashback rates, programme terms, or participating partners at any time with reasonable notice. Material changes will be communicated by email or in-app notification.

6. Bookings and Cancellations

When you make a booking through sheerME:

• You enter a direct appointment agreement with the Salon Partner. sheerME facilitates but is not a party to that appointment.
• You must cancel at least 24 hours before the appointment to avoid forfeiting cashback.
• Cancellation policies of individual Salon Partners may also apply. Check the salon’s policy before booking.
• If a Salon Partner cancels or significantly changes your appointment, your cashback entitlement will be protected and a loyalty credit may be applied.

7. Salon Partners

sheerME verifies that Salon Partners are legitimate businesses before listing them on the platform. However, we do not directly provide beauty or wellness services and are not responsible for:

• The quality of services rendered by Salon Partners.
• Any injury, loss, or damage arising from a visit to a Salon Partner.
• A Salon Partner’s failure to honour a booking.

If you experience issues with a Salon Partner, please report them to us at [email protected] and we will investigate and act accordingly, including potentially removing the partner from the platform.

8. Payments and Withdrawals

• Cashback in your sheerME wallet has no expiry date.
• You may withdraw available cashback to your linked bank account at any time. There is no minimum balance required to withdraw.
• Processing times for withdrawals depend on your bank and may take 1–3 business days.
• sheerME does not charge fees for cashback withdrawals. Your bank may apply its own fees.
• We reserve the right to withhold wallet funds pending investigation of suspected fraud.

9. Prohibited Conduct

You must not:

• Create fake accounts or book appointments with no intention of attending.
• Manipulate the cashback system through fraudulent bookings or cancellations.
• Harass, threaten, or abuse Salon Partners, sheerME staff, or other users.
• Post false, misleading, or defamatory reviews.
• Use the platform for any unlawful purpose.
• Resell or commercially exploit access to the sheerME platform.

Violation of these prohibitions may result in immediate account suspension or termination and, where warranted, legal action.

10. Intellectual Property

All content on the sheerME platform — including text, logos, graphics, software, and design — is owned by or licensed to sheerME and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

User-submitted content (e.g. reviews) remains your property, but you grant sheerME a non-exclusive, royalty-free licence to use, display, and reproduce that content on the platform.

11. Disclaimer of Warranties

The sheerME platform is provided “as is” and “as available”. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the platform will be uninterrupted, error-free, or free from viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable EU and Portuguese law:

• sheerME’s total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the total cashback credited to your account in the 12 months preceding the claim.
• sheerME shall not be liable for any indirect, incidental, consequential, or punitive damages.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

13. Termination

You may close your account at any time by contacting us at [email protected]. Any available wallet balance will be paid out to your linked bank account within 14 days of account closure, provided no fraud investigation is pending.

We may suspend or terminate your account at any time for breach of these Terms, fraudulent activity, or for legitimate business reasons, with or without notice. Upon termination, your licence to use the platform ceases immediately.

14. Governing Law

These Terms are governed by the laws of Portugal and the applicable regulations of the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal, without prejudice to your rights as a consumer under EU law (including the right to use the EU Online Dispute Resolution platform).

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated Terms.
